I was told by the irs that the best resolution was to file your taxes as you normally would. If two people claim the same child a red flag will go up. The person that claimed them will have to provide additional information. You will be asked to do the same. However since you are the one that provides care continually you will be able to provide the proof. The other person will eventually have to repay those funds back to the irs. The process will be long .

This is a total nightmare! I am the sole caretaker for my children and out there is some a-hole who continues to claim my child as his on his or her tax returns. This is the second year I am going through this and the fact that there is nothing I can do makes me more furious! What is the IRS Doing these days!!!
That is something that you will have to talk about with the tax office, and know that if someone else did, and the child is in your custody, then that other person will get in trouble. Hope this helps, good luck to you.
