I work from home in California, I took 6 weeks off after advising my employer, to take care of foreclosure and other personal issues, after returning to work my employer advised me my position was terminated but that I could relocate to the east coast or accept a severance paid biweekly for 6 weeks, and position to sign a bunch of legal paperwork, (they gave me 3 days to make the decision), can I receive unemployment during severance or after, and who would you advise I speak to about this, the EDD counselor or a lawyer.
Can You Receive Unemployment Benefits While Receiving Severance Payments From Your Previous Employer?
From the California EDD.CA.GOV website.
How does severance pay affect my eligibility to receive unemployment insurance benefits?
Severance pay is not deducted from unemployment insurance benefits and does not affect your eligibility to receive benefits. The method of payment, such as a lump sum payment or payments paid to you at regular pay period intervals does not change the nature of the payment. However, you must report severance pay at the time you file your unemployment insurance claim.
It's your right. Don't let the govt or your employer fool you!! Get what your deserve and have earned!!

No, you'll have to wait until the severance runs out so time it so the unemployment starts when the severance runs out.
