For the tax year 2010, the deadline for filing Maryland state income taxes was April 18th 2011. If you have not met the deadline it is important to contact the Tax Office to arrange filing your taxes. Often if you keep the department updated and do not appear to be trying to avoid paying your taxes, they will make some allowances for missing the deadline.

Normally, if you do not respond to the first notice requesting you to file your state taxes, you will receive an assessment notice that will include substantial penalty and interest charges. Maryland law presumes that the assessment notice is correct and in order to dispute the amount due you will be required to file, appeal and request a hearing within 30 days of receiving the assessment. If you choose not to appeal, collection procedures will begin after the expiration of this one-month period. This assessment will be based on the amount of taxes Maryland’s office believes you owe. There will be an interest charge made at the annual rate of 13 per cent, and it will be calculated from the day that the taxes were originally due. Any penalties that you may receive will be charged at up to 25 per cent of the amount of tax you owe. Failing to settle your account promptly after receiving an assessment notice will result in legal action. This legal action may include filing a property lien, referring your account to an outside collection agency or attaching your bank accounts and salary.

It is possible to arrange a payment plan for your taxes if you are having trouble financially meeting the deadlines. As long as you keep the office informed of your situation and show that you are willing to negotiate, you can avoid further assessments and penalties.
