I think you do need a license. We need licenses for everything these days. Something to consider is what you need to do to get it. In other words you have to have a clean environment. You need sufficient work space and proper fire hazard equipment. The health department will send someone to inspect your place. On the other hand, if you are just baking some candy for a school or church bake sale then you are fine.
