Actually you can - sort of.  I'm assuming you bought the property "subject to" the existing loan?  If so there should be a quit claim deed to you.  The bank will still send the interest info to the person on the note but as long as they don't try to claim the interest as well you shouldn't have too many problems.  If the scenario is something else then you need to see a good CPA and have them figure it out.

Actually it’s no, simply because you don’t have the authority for the claim of mortgage interest, since it’s not in your name. You must have an authorization document to do so.

No because when they checked your information they would not find you listed as the mortgage holder......good luck
