If the children lived with you for more than six months or you provided over half of their support for the year, and/or your ex-wife, "who is the custodial parent", signs a form 8332 or similar statement that she will not claim the children on her tax return, then you can claim them.
That's what my Tax preparation book says, may be more to it, you can call or go online to the IRS website at www.irs.gov to ask questions.

Generally, if you provide support to your children, you should be able to share in the income tax benefits, but each case is a different matter. Talk to the IRS office near you. There are cases where 2 people can claim another on Taxes.

Good answer pencil: just wanted to add, since there are 3 children, why couldn't you make an agreement with her to allow you to claim 2 one yr. and her to claim 2 the next yr.? Food for thought.
