The reason for not being able to claim unemployment during the summer vacation is that they are employed for the other months of the year, and are still technically employed, even though they don't get paid during the period of the vacation.

Unemployment benefits are decided by the state that the person in question is resident in, and they are made by the state. These benefits are based on the basic needs required to survive, and it would be argued that a teacher's aide's salary, even though they don't get paid during the summer vacation, would be high enough to survive upon throughout the period of an entire year.

The amount of unemployment compensation people receive is based on an annual figure, which includes any salaries received throughout that particular year. Teacher's aides would therefore be expected to factor in these when budgeting for the year, and making sure that enough money was left over to cover general living expenses during the period of non-payment of employment.

The benefits are normally only part of a larger scheme of social security and are only given to those people who are registering as unemployed and do not have a job, which in this case a teacher's aide does.

Unemployment benefits are generally paid for a maximum of 99 weeks to anybody who is unemployed through no fault of their own, and people who leave their jobs of their own accord are not eligible. Part-time workers are not usually eligible either as their gross annual income would be above the threshold that makes people eligible.
