How To Fight Unemployment Denial?

There are usually 3 opportunities to fight a determination that you do not agree with. The first level is a hearing with the uc referee. If you are denied by the referee, you can file an appeal to the uc board of review. Be sure to get your appeal in within the time the uc office requests, usually 15 days. If you are denied by the board, then you may appeal to commonwealth court. I believe you are given a longer time to get this appeal in, 30 days. This is usually done before a district justice or magistrate. I have never seen cases go any further than this level. If you do not appeal before the date indicated on your determination letter, then expect to have to file what is called a late appeal. In a late appeal, you must first make your case as to why it should be heard, the reason for your lateness in filing the appeal. Then you will make your case as to why you disagree with the determination. It is much easier to just get the appeal in on time. Granting a late appeal is usually done due to a local office error, or a natural disaster, or incorrect addresses which falls under the local office error category.

I was fired, reason "at will policy", I have field for unemployment they sent a letter stating that I am eligible. But I also got another letter that they (old employer) is fighting me. I will admit I was surfing the net, then I got a warning and I stopped it all. After the warning I only went on the net for job related issues nothing more nothing less.

I was working as a truck driver and my job had gotten very stressful. I had informed the dbl that I was very stressed out because of low mileage and they acted like they did not care and told me that my miles were going to be cut due to freight. I was having trouble eating so I smoked a joint to increase my appetite. I was given a drug test shortly after and failed the drug test. Therefore I lost my job. I waited over 60 days and filed for unemployment. I keep getting denied benefits. I would like to get a lawyer to help me with this appeal. How do I do this?

Cashing your own check and then it turning out to be an NSF is considered stealing from your job. That's why you were terminated.
