How Much of My Paycheck Can They Take? If you do not have an exemption they will take part of your paycheck for the next 70 days. You still keep either 75% of your net wages, or 40 times the minimum wage for each week you work – whichever is more. "Net wages" are the pay you take home. They are what you earned minus things like taxes and social security that the law says must be taken out. The part of your wages that you still keep (75% or 40 times minimum wage) is automatically exempt from garnishment. If you put it into the bank, it will stay exempt, but only for 20 days.
