I have been a leasing officer for many years and have encountered quite a lot with the same problem. First, an agreement is still an agreement with or without a written form. Better if your friend received from his tenant at least the first rental payment; coz that's an indication that he honors the verbal agreement and is committed to it. However, if there was no payment at all, all your friend has to do is send his tenant a demand letter giving him at least 15 days to settle all his obligations or vacate the leased premises. After the 15-day period and still no response, send another letter, this time, give him 3 days; failure on his part again shall constitute sufficient ground to padlock the room. In so doing, it has to be witnessed by a 3rd party. If in case, the tenant pays, make sure to make an agreement in black in white this time. Good luck!

No, if you want to get him out, you have to go through the court, it doesn't matter that it was verbal, if he isn't on the lease, he shouldn't be there anyway. If you go to the landlord/tenant board, they can better tell you how to go about this and what your rights are. Hope this helps. Good luck.

As there are no legal documents of her living there you can evict her. However, I know in the state of New York (and possibly others) you need to give 30 days for them to leave if they have proof they've lived there for a month or more proof is considered an id with the address or bills.

If she is not late in rent, you need to give her 30 days notice to vacate. If still she doesn't vacate, you will have to go to court for a court order.

Landlady starts cleaning anywhere from 9:30PM until 11 or later. I am in basement apt and she has no carpeting in her house. Spoke to her about it - she said she would try to remember not to do this. I am 62 years old, work all day and would like to fall asleep without being startled from my sleep, She has no problems with me as a tenant. Doe she have the right to do this so late?

I live in an apartment I rented from this elderly lady I have lived there for about 7 years, pay her my rent on time always, she died last year there has been no family members claiming the property I think she owes mortgage money I don't know.  But now the city had said to me that I have to pay them so I went to court and yes I am pay the rent to the city.  But now the bank has a hold on the house and property and it is out on the market for sale.  So therefore I have to move out what do I do what are my rights do I get money to relocate I do not know I ask and no answer is there anyone that can help me.

I hate 2 b the bearer of "bad news" but what state is this taking place in?  Because in most states (in the USA) if he/she/they has(ve) 1 of 3 things he/she/they has(ve) tenant rights:  1) rec'd mail at residence  2) has a key to residence or 3) has spent at least 1 full night at residence.  If yes can b answered to any of these 3 aforementioned "acts" depending on which state has jurisdiction...chances are said "tenant" must b evicted thrthe courts as tiggersmom has correctly implied.

I am rent an apartment and the landlord has not given me a copy on the lease as yet. Can he evict me from the property? The only prof I have is the receipt of first months rent and security.

Yes you can. You need to do it legally though, you cannot just tell her to leave. You probably have to give her a notice to vacate in 30 days, and if she does not leave, proceed with a court filing to evict her.

This tenant was given notice since May 2009, then served 1 week holdover notice from 1/9 -1/15/2011. The tenant did not adhere to either verbal or written notices. He has no lease and occupied a furnished room. What should my next move be.

You can get her in trouble for misjudgement of character it is illegal. You need to go to court and take care of this asap!!

I.ve been a landlord for many years. One important thing I learned when evicting women is to bring along a witness whenever I serve an eviction notice to a woman. Simply because women are quick to make up fabricated accusations of lies of sexual misconduct. Thank goodness I had the foresight to bring my wife as my witness on many occassions. I could go on and on of such types of experiences

If you eviction a tenant and didn't do a lease agreement, you have to be careful of what you are eviction the tenant of. You would have to go to court and let the job know why you are eviction the tenant of.
