The simple answer is that depending on the income both parents earn and if you are the primary custodian of the child you may be able to get some support. Your income will be a factor to determine if you need child support. Each state has a specific way they handle child support. Some will award the money whether you need it or not. It is also important to have a job if at all possible in order to be looked on favourably by the judges. Payments are made by the non-custodial parent to the child support probation office in order to make a record that payments were actually made. Yes.  My Ex owed $33,000 in back child support for our three kids.  He filed for disability April 2008 my three children each receive a check from social security and a check from child support each month.  These checks are deducted from his disability check each month.

Oh, I am sure this is true! Not only does each child get a check of $300.00 per child from SSD, the fact is it could be much more depending on how much the custodial parents previous earnings were. It would never be less than $150.00 per child though. This is the certifiable facts. So that is what each child would get from the social security fund. This is given with the child support. That money comes from the fund, not from the parent. 3 kids would equal $900.00 plus the child support!

In MA Children can not receive both SSDI and an additional Child Support payment, unless there is a significant difference.  They use the SSDI payment as part of the non-custodial parent income and factor out what the weekly payment should be.  Say it ends up being $124 a week, but the child receives $170 a week from SSDI.  Then there will not be a separate attachment.  However if the child only gets $100 per week then an additional $24 would be deducted from the non-custodial parents SSDI payment.

FYI for those of you who get a check from SSDI directly for your child, then receive a child support payment deducted from the parents SSDI check....SSDI can in the future ask you to pay back the over payment.

I'm in California on SSDI due to my eyesight blind in one eye and legally blind in the other eye.  I use equipment to see on my computer making print larger and only see straight ahead blind due to my Diabetes on the bottom, top, right, and left sides.  I went to Child Support Services to find out one if I'm the father and two because my brother didn’t pay right away he owed a lot many years later after having kids.  

I pray this lady was not right she said they can get $685.00 from me every month.  I don’t bring in $1000.00 a month that would leave me broke every month without getting a job.  And I cannot do that right now due to my health problems with my eyesight and Diabetes both.   That to me does not seem fair for a guy who does not bring in enough except to live in general to afford Rent, Utilities, Food, Clothes, and Bills.

More and more people are using social security and SSDI as a way out of supporting their children. This loophole must be closed soon so these children can receive the support they need. People who are on SSDI or this-abilty should have a medical re-evalution every three to six months to prove their status. More and more kids are living and going without when one of their parents (usually the non custodial parent) goes on SSI  or SS and then work under the table to get out of the way of a larger child support order. These "disabled" parents can even increase their own SSI payments to themselves by having more children with another partner or spouse by decreasing the SSI payment to the custodial parent of the other child, this is wrong. If these so called "disabled " parents can't physically work and support the children they already have, they shouldn't be rewarded by physically bringing more children to support into the world and states should hold these frauds accountable and issue court ordered child support as well as award SSI payments to the custodial parent.

Don't be so ingnorant. Disabled parents DO support their kids with Money they PAID into their Social Security DISABILITY INSURANCE program. IT's NOT a hand out, it's 50% of OUR insurance benefits, being paid back to kids of those unfortunate enough to be to ill to work, BASED on what we EARNED while we could. Children ALREADY GET a benefit of their own from SSDI from the disabled parent's account. This IS their child support. The remaining paltry sum is supposed to cover our living expenses.

Well I hope that the laws change soon, because I have the same situation...... My SSD  check is cut in half...and just to make it worst the mother and my son are non citizens and live in mexico......

I am getting a divorce and have some health issues and am applying for social security disability, will I be able to get spousal support along with the ssi

Well, I hate 2 tell you but this is fact. I became Disabled and could no longer work. Have Diabetes and Anal Bleeding, Extreme Cholestol, I total screwed Back and a lot more smaller issues. Had Surgery and it got infected because the Courts Give my ex-wife 365 in Child Support and 300 in Spousal. They took me to court on several "Show Causes" and recieved Back Payment Money as well they take 65% of my Disability (in which I recieve 708 dollars a month) Child and Spousal take 460 directly of my check and are trying to have me locked up because "The Order" is forcing me to pay 897 dollars a month so I continuiously have been falling behind. I put in for a Review to lower the payments and was told "The Order placed by the courts CAN NOT be REVIEWED until after 3 years."
I pushed and Pushed....they finally gave me a Review. Went to court and it was dismissed because the Child Support enforcement took me to a court that was "Out of jurisdiction" Since it was dismissed I had to file again. But Again with the Letter saying I must wait 3 years. I pushed for another year for them to "PLEASE HELP ME." I worker finally pushed it through. I went to court. When I showed up the Child Support With drew the case and said they would like the order removed from the docket and "Transfered to the Location where the Ex and Child Live." So it was transfered to another county. Since the fight they  took my Driver's License (EVEN THOUGH THEY ARE TAKING FROM SSDI) and was told that to get my license back I must give them 1,363.67 and sign an agreement to pay 897 dollars a month and if thier computer had SO MUCH AS AN ERROR and the Payment was NOT POSTED ON THE 1st I WOULD NEVER SEE MY LICENSE AGAIN. Again I only recieve $708 Dollars a month???? And am told now (by the Child Support office) that the next time I got to Court  It will not be for 6 months and I will be going up against a lady Judge who is VERY STIRCT ON MEN??? And was also told the BEST I could hope for in the review is My payments lowered but will STILL NEED TO PAY the 23,000 Dollars I owe trying to fight for a reveiw in which I have been Jerked around. And all this because as I was getting a Divorce they gave her custody. Also during the Divorce the Lawyer "Dug Up" she was an "Illegal" from Canada??? But the court Gave Her my Child, Child Support, My Car (which is Still 4 years later, Driving in town with "Farm Use Plates" and Every Ticket she gets INCLUDING a 500 dollar Parking Voilation from D.C. To me. And I can not drive??? Illegal or NOT the courts are Designed to help the Woman. Virginia Spells Vigina if you take out a few letters Not to mention Our Flag has the Women Standing on top of a Falling Man Does it not? But yet Women Murder their Men and the Courts award them "Because the Man must have Provoked her" I see battered men all the time and I was even one but the "Battered Shelters" and "Support Groups" are only for Women??? The point is if you are a man YOU DO NOT STAND A CHANCE...This is what "LIBERATION" has gotten us.

MY husband of 8yrs has a 16,17, year old teens, he is on ssdi this abilty and they never took a dime, until one day this check was cut in half 50% he has less then 400 a month to live on. Chlid support is to caulcalate the amouts and lower is payments to about 5% per month. This is a califronia Law and ssi can not be touched what so ever.

Your answer to this person is insane. First off you do not know the circumstances to be making a snap judgement that this guy did not pay support in the first place. In NY, especially the courtrooms of Suffolk County, the men get a very unfair shake. I am a woman who works for a father's rights firm and I have to tell you, if a judge stated he wanted 75% of a man's money to go for 1 child, it would be done, period! If you owe arrears, your SSD could be docked up to 55% or more. L.I. Is unfair
