Unfortunately anj, zuhail is incorrect again and if you listen to him, you'll be getting wrong information. Your friend has established residency  in your apartment, and weather this person has a lease or not, if he or she wants to put up a fuss, and fight it, you will have to take them to court to get them removed. I'm not saying its right, and your friend should move on their own, however as I said, once you allow someone occupancy in your house or apartment, this is establishing residency, and you have to go through the courts if they wont move.

What exactly should I do then?? Because I have sort of the same situation. My roommate is not on the lease either and she just moved in less than a month ago and already we are fighting constantly. Its stressing me out so much I don't even want to come home. Ive been living at my apt. For 2yrs already and have never felt so horrible. Any advice I would deeply appreciate it. Its really affecting me emotionally and I really like my place. Please help.

She is illegal at your residence. You don't need to give her 30 days notice as she is not bound by any contract. Your landlord can kick her out legally. You have to talk to him to give her a notice for staying illegally.

According to me, Your landlord could legally kick her out because she's not on the lease. But you could also get in trouble for letting her live there without putting her on the lease.
